If you have something to say, and acts to prevent you from saying whatever it is you want to say, you're being censored.

Acting to prevent the dissemination of information to the general public - that is censorship, and it takes many forms. It could be deleting comments or user-submitted news stories from a website, it could be taking control of a live news broadcast by the use of force of arms, it could even be tying someone up and stuffing a gag in his mouth - if it prevents someone from disseminating information of interest to the general public, it's censorship.

Granted, there are times when censorship is appropriate, but in the case of policies designed to strip people of their rights (such as the Patriot Act and the DMCA), it's not.

You've asked a tough one here, Kevin. My initial thought was "both." But the more I think about it, the more I think it leans more heavily toward the inability to speak. If you aren't being heard, that's not censorship, that's not shouting loud enough.
