Spreading US Copyright Law without Even Knowing What that Means
MSNBC is running a story about the US Trade Representative's goal of negotiating a new intellectual property pact which would benefit the American companies who export their IP.
The money quote is from the Chairman of the Senate Finance Committee, Montana Senator Max Baucus:
"Ideas are America's true currency and if we want to be economically competitive, strong protections for U.S. intellectual property are key."As readers of this blog will know, you cannot copyright ideas. Though the dichotomy between expression (qualifies for copyright) and ideas (not allowed copyright) is subtle, as a protector of the Constitution and exporter of American legal systems, I would hope Mr. Baucus would review it.
Anyways, as I wrote in the beginning of this nearly year old blog, America started as a "pirate nation" which didn't respect the intellectual property of others. However, as a net exporter, we are now using our hegemonic position to push our ideals of copyright onto other nations and people who don't have the same historic background.

Seems you are being a little too technical here. This guy is speaking for the public, not for a copyright law class. To use the word expression instead of idea would be confusing to the general public who do not know the specialized legal meaning of the words. I am not convinced that he doesn't understand copyright law.
lawprof - I think that is a fair criticism. However, his "ignorance" here (whether intended or not), is in line with what I see as further wrongheadedness.
I am wary of spreading our legal system to places where it very well may not be in their long-term interest.
I don't see how we can push the American concept of copyright laws onto other nations when we can't even get them to work here. The copyright laws are such a mishmash that even professionals don't understand them. And in the end, of course, what matters is not how the laws are written but what you can afford to spend on legal representation. There’s a sad example of this in my recent article titled "Copyright Confusion" available at http:// www.theinternetwizards.com under the menu "Past Issues & Articles."
