Linux Violates 235 Patents, Says Microsoft
Fortune Magazine has a lengthy article about the coming patent war between Microsoft and Linux users/distributors. As former Microsoft employee Robert Scoble points out, Microsoft has historically not used patents offensively (ie: sued for infringement), but this allegation and the recent deal between Novell & Microsoft suggests that Microsoft will use the courts to attack Linux.

Sounds to me just wrong what Microsoft is doing. One of the biggest problems of Microsoft is the public relations, this won't make it better. And I would like to see linux distributions complaining about Microsofts "ripps offs "
The title is inaccurate. OpenOffice isn't Linux. Assorted e-mail programs aren't Linux. Even X isn't Linux (most Linux servers don't even run or depend on X). Linux the kernel only allegedly violates 42 patents.
The title should read: "Assorted Open Source programs violate 235 patents, say Microsoft" or something of the kind.
Still a big deal, no doubt. Microsoft had to pay 1.5 billion dollars just a few weeks ago because it violated one single patent.
If you needed proof that SCO's lawsuits are dead, this is it. Microsoft realized that they will need to get their hands dirty.
This is so bogus. As Linus has said before, please show me the places where the Kernel (the only thing that *is* "Linux"), and withing hours, we will have that part written out. As most applications in a Linux Distribution are written by different people, Microsoft would have to go after literally *THOUSANDS* of people, suing them on a scale not seen in even by the RIAA's misguided attempts at suing their customers.
Like much of which comes out of MS, this is just Vapourware....
MS was found guilty in a US court for using BSD code without credit.

If you look into it, they've been busted over and over and over again for patent violations, often after 'negotiating' with small companies.

Of the 235 patents 234 are obvious and the 235th is useless so it shouldn't be a problem though.
Everyone ripped off Xerox, no idea why Xerox hasn't stepped in and sued everyone yet. Probably didn't make any patents or some legal bullshit.

While SCO's claims were outrageously untrue, Microsoft most-likely does have some infringed patents. It is impossible to write software of any substantial size that doesn't infringe someone's patents.
That said--I think this will either take down the Open Source World or it will take down Microsoft and possibly software patents entirely.
I think most judges will be highly adverse to taking down the entire patent system. If there is any excuse as not to see software as unpatentably mathematics, they certainly will.
If Microsoft muscles open-source out of the US (can't do it in all the countries) I will have several nice modern looking flower boxes...lol.

Most or all of the IP patents that are being violated ( IF ANY), are probably from the ReactOS opensource Windows 2000/XP CLONE. It's gui and install looks identical to Windows 2000. It aims to be binary compatible and run all programs and drivers. This Project is probably a Microsoft sponsored project so that it can claim opensource violates it's patents. Microsucks doesn't compete fairly. They are the ones that brought baystar to back SCO With $50,000,000 to help them with their lawsuits against Linux.

I noticed someone made a comment about ditching linux and getting a real operating system.. I bailed on windows when vista hit the shelves, I started using Ubuntu.. I now find myself annoyed at the instability and lack of control I have in windows. and don't get me started on drivers, In linux, everything works fine for me as I plug it in, In windows I fought for 8 hours trying to get the drivers right.. and I had to pay for windows? wtf
